Terms of Service

General information

These Terms of Service (“Terms”) apply to your access and use of all apps and services by Linas Nutautas, published under the name linasdev (“we”), including the apps released on the App Store and, in future, Google Play under the Linas Nutautas developer account (the “Service”). Please read them carefully.

Where an app's own website publishes terms for that app, those terms apply to it: Migraine Tracker, SetGrip.

Accepting these Terms

If you access or use the Service, it means you agree to be bound by all of the terms below. So, before you use the Service, please read all of the terms. If you don't agree to all of them, please do not use the Service.

We may modify these Terms at any time — for example, when we release a new feature. When we do, we update the “Last updated” date at the top of this page. Continued use of the Service after a change means you accept the updated Terms.

Purchases and subscriptions

Some apps offer optional in-app purchases and auto-renewing subscriptions. All payments are processed by the store you bought from — Apple through your App Store account, or Google through Google Play — and that store's terms apply to the transaction. A subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.

You can manage or cancel a subscription at any time in your App Store or Google Play account settings. Refunds are handled by Apple or Google, not by us — request them through their support. Prices, features and free trials may change over time; changes never apply retroactively to a period you have already paid for.

Third-party services

From time to time, we may provide you with links to third-party websites or services that we do not own or control. Your use of the Service may also include the use of components developed or operated by a third party.

Your use of such third-party applications, websites and services is governed by that party's own terms of service and privacy policy. We encourage you to read the terms and privacy policy of any third-party application, website or service that you visit or use.

Your data

Our apps do not require user accounts. Your app data is stored on your device and, where the app supports it, synced through your own private iCloud database, which we cannot access. Keeping a backup of your device and your iCloud account in good standing is your responsibility. For details on what we do and do not collect, see our Privacy Policy.

Acceptable use

You agree not to:

  • copy, distribute or disclose any part of the Service in any medium, including by automated or non-automated “scraping”;
  • use any automated system — robots, spiders, offline readers and similar — to access the Service;
  • transmit spam, chain letters or other unsolicited messages through the Service;
  • interfere with or compromise the integrity or security of the Service, or decipher any transmissions to or from the servers running it;
  • take any action that places an unreasonable or disproportionately large load on our infrastructure;
  • upload invalid data, viruses, worms or other harmful software through the Service;
  • collect or harvest personal information from the Service;
  • use the Service for commercial solicitation;
  • impersonate another person, misrepresent your affiliation with a person or entity, or conduct fraud;
  • reverse engineer, decompile or otherwise attempt to derive the source code of the Service, except where that right cannot be excluded by law;
  • bypass the measures we use to prevent or restrict access to the Service.

Intellectual property

All content, trademarks, service marks, trade names, logos and icons are proprietary to Linas Nutautas or its licensors. Nothing contained in the Service should be construed as granting, by implication, estoppel or otherwise, any license or right to use any trademark displayed on the Service without the written permission of Linas Nutautas or the third party that may own it. App Store is a service mark of Apple Inc. Google Play is a trademark of Google LLC.

Health and financial information

Some apps let you track health, fitness or financial information, and some offer optional AI-generated insights. This content is provided for general informational purposes only. It is not medical, legal or financial advice, and it is not a substitute for professional judgement. Always consult a qualified professional before acting on it, and never disregard professional advice because of something you read in an app.

Disclaimers and limitation of liability

THE SERVICE AND ANY OTHER SERVICE AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE ARE PROVIDED TO YOU ON AN AS IS OR AS AVAILABLE BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND. WE DISCLAIM ANY AND ALL WARRANTIES AND REPRESENTATIONS (EXPRESS OR IMPLIED, ORAL OR WRITTEN) WITH RESPECT TO THE SERVICE AND CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE WHETHER ALLEGED TO ARISE BY OPERATION OF LAW, BY REASON OF CUSTOM OR USAGE IN THE TRADE, BY COURSE OF DEALING OR OTHERWISE.

IN NO EVENT WILL LINAS NUTAUTAS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR ANY OTHER SERVICE AND/OR CONTENT INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICE, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR ARE AWARE OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CAUSES OF ACTION AND UNDER ALL THEORIES OF LIABILITY WILL BE LIMITED TO THE AMOUNT YOU PAID TO LINAS NUTAUTAS. THIS SECTION WILL BE GIVEN FULL EFFECT EVEN IF ANY REMEDY SPECIFIED IN THIS AGREEMENT IS DEEMED TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Nothing in these Terms limits rights that cannot be limited under the mandatory consumer protection law that applies to you.

You agree to defend, indemnify and hold us harmless from and against any and all costs, damages, liabilities and expenses (including attorneys' fees, costs, penalties, interest and disbursements) we incur in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party relating to your use of the Service, including any claim that your use of the Service violates any applicable law or regulation, or the rights of any third party, and any violation by you of these Terms.

Governing law

These Terms and any action related to them are governed by the laws of Norway, without regard to its conflict of laws provisions. If you are a consumer, you also keep the protection of the mandatory law of your country of residence.
